TERMS AND CONDITIONS

PORTUGAL NATIONAL GEOGRAPHIC JOURNEY WITH G ADVENTURES

October 18-26, 2025
National Geographic Journey starting the evening of October 19, 2025

The journey begins in Lisbon (LIS) and ends in Porto (OPO)

If you do not agree with any part of this Agreement or are unwilling to be bound by its terms, please do not proceed with the retreat registration.

You will receive this in PDF form with your booking invoice. By making payment, you acknowledge that you agree to the terms of this agreement and understand that it includes a release of liability for any injuries and damages.

IMPORTANT NOTES: Portugal features diverse terrain, including regions with steep streets and uneven surfaces. Please bring sturdy walking shoes with good grips for the cobblestone walkways, and be prepared for a lot of walking.

LUGGAGE: In Portugal, elevators in train stations or other public places are rare. We use public transport on this trip, meaning you will need to carry your luggage from platform to platform, in and out of trains and buses, etc., and possibly up several flights of stairs. You will also need to be able to stow your luggage safely on trains and buses. Therefore, you must pack light and bring luggage that is compact, lightweight, and easy to transport.

TERMS & CONDITIONS & WAIVER RELEASE FOR TRAVELERS

When you (referred to as “you,” the “traveler,” “client,” or “student”) book a trip with Linh James (referred to as “we,” “us,” or the “Organizer”), you are deemed to have agreed to these Traveler Terms & Conditions. As part of your experience, you may participate in walking tours, hiking, swimming, yoga classes, breathwork sessions, sound healing, wellness programs, workshops, or other forms of bodywork, exercise, therapy, and healing arts (collectively referred to as the “Activities”). These activities may be led by Linh James, also known as Guru Mitar (the “Teacher”), or other guides and facilitators.

Activities may take place in person at physical locations or be offered online through video, livestream, television, podcasts, apps, or other digital platforms. All such offerings—whether in person or virtual—are considered part of the “Activities” referenced in this Agreement.

CHANGES, POSTPONEMENT, & CANCELLATION BY US: We reserve the right to make changes to any aspect of the retreat if necessary due to conditions that are likely to be hazardous, dangerous, or due to any other adverse or threatening conditions, whether political, military, terrorist, pandemic-related, or otherwise. This also applies if an act or omission of a third party prevents the retreat or any aspect of the retreat from being undertaken in accordance with your booking or for any other reason considered necessary by us. The itinerary listed for each trip represents a general plan (including the day-by-day schedule of activities). However, you acknowledge and accept that circumstances may arise that may result in changes to the listed itinerary.

Additionally, we reserve the right to cancel the retreat at any time if, due to natural disasters, political instability, or other disruptions and/or events beyond our control (“force majeure events”), the operation of the trip would be unsafe or otherwise unviable. In the event a trip is canceled due to a force majeure event, you will receive a refund equal to the monies paid to us, less any costs incurred by Linh James that are not recoverable.

FORCE MAJEURE:  If the organizer is inhibited (directly or indirectly) from performing any of its obligations under this agreement by reason of an act of God, natural disasters, interruption of transport, government or political action, acts of war or terrorism, or for any other cause outside our control, we will be under no liability to you and may cancel the retreat or take any other action.

MANDATORY TRAVEL INSURANCE

YOU MUST HAVE TRAVEL INSURANCE WITH A MINIMUM MEDICAL, EVACUATION, AND REPATRIATION COVERAGE OF $200,000 covering all applicable travel dates. This insurance must cover personal injury and emergency medical expenses.

Travel insurance is compulsory for participating in the trip. Travel Insurance policy information will be required before leaving for the trip. Once arriving, our CEO will verify your travel insurance document; you will not be permitted to join the group until evidence of travel insurance has been sighted by your CEO (group leader).

  • When selecting a travel insurance policy, we require that, at a minimum, you are covered for medical expenses, including emergency evacuation and repatriation.

  • A minimum coverage of $200,000 is required.

  • We strongly recommend that the policy also covers personal liability, cancellation, loss of luggage, and personal effects.

  • If you have credit card insurance, we require proof of trip purchase (a receipt of credit card statement) with a credit card in your name. Contact your bank for details of their participating insurer, the level of coverage, and emergency contact telephone number.

You acknowledge that insurance coverage is not included in the cost of any trip/tour offered, and you are required to obtain separate coverage at an additional cost. You are responsible for ensuring that you have sufficient coverage and comply with the terms of the applicable insurance plans. You are responsible for advising your insurer about the type of travel, destination(s), and activities included in your booking so that the insurer may provide appropriate coverage.
Each client is solely responsible for any losses, penalties, fees, or other financial consequences that may result from booking, canceling, or interrupting a trip. This includes, but is not limited to, expenses related to airline tickets, passports, visas, and medical care. For this reason, we strongly recommend purchasing travel insurance as soon as your booking is confirmed.

Intercity transport on this trip will be mainly by public bus and train. The bus and train systems in Portugal are generally very good, most offer seat reservations, some buses have toilet facilities and others don't, but drivers often stop en route for service station breaks.

Please note that we use public transport such as metro and taxis to get to train and bus stations. It is essential that you can carry your luggage comfortably and that it can be packed into a relatively small space. Between transport and hotels, you may be required to carry your luggage short distances (up to 15 mins walk), occasionally the group will take taxis to and from hotels.

PASSPORT AND VISA It is your responsibility to obtain information and have all the required documentation and identification for entry, departure, and travel to each country or region. This includes a valid passport and all travel documents required by the relevant governmental authorities, including all visas, permits, certificates (including but not limited to vaccination or medical certificates), and insurance policies.

You accept full responsibility for obtaining all such documents, visas, and permits before the retreat starts and for the full amount of costs incurred due to missing or defective documentation. We are not responsible if you are refused entry because you lack the correct travel documents.

While we provide the following information in good faith, you must check the information yourself and understand that you are fully responsible for your visa requirements.

  • You must have a passport valid 6 months after the last travel date as set out on your itinerary.

  • Visas - U.S. citizens traveling to Portugal do not need a visa if their stay is under 90 days.  This information can change at any time.  You are responsible for verifying Visa requirements.

  • As of 2025, various European countries are introducing ETIAS travel authorization as an entry requirement for visa-exempt nationals.

We highly recommend you check in advance how your nationality and country/s you are visiting may be affected. Further details can be found at:  https://travel-europe.europa.eu/etias/what-etias_en

ROOMMATE REQUESTS:  We make no promise or guarantee that we can match you with a roommate for the double occupancy rate on any given trip. If you are traveling solo but do not want to pay the higher single occupancy price, please notify us when booking. We will do our best to match solo travelers with a roommate of the same gender to accommodate the lower double occupancy rate request.  We reserve the right to make changes to roommate assignments.

If we cannot match you with a roommate by the final payment due date, you will be charged the single occupancy rate, which is an additional $1,384. If we are able to match you with a roommate after you have made the final payment (including the single occupancy surcharge), we will happily refund the single occupancy.

IMMUNIZATIONS AND TRAVEL ADVISORIES/WARNINGS:

You assume full responsibility for verifying and obtaining any required or recommended immunizations, vaccinations, or preventive medications necessary for travel to the destination country(ies) and/or region(s).

You also acknowledge that it is your responsibility to research and stay informed about the safety, security, and health conditions of your destination(s), including reviewing any travel advisories or warnings issued by relevant government agencies such as the U.S. Department of State or Centers for Disease Control and Prevention (CDC), or their equivalents in your country of residence.

It is strongly recommended that you consult with a physician or travel medicine specialist who is knowledgeable about the specific health considerations and requirements of the countries and regions you will be visiting.

HEALTH AND FITNESS REQUIREMENTS:

This retreat/adventure is not recommended for individuals in wheelchairs or with limited mobility. Participation in classes and activities is always optional.

By booking, you confirm that you are in good physical and mental health, are mobile, and are capable of participating in the activities included in your chosen trip. You also confirm that you can care for yourself throughout the retreat and will not impede the progress of the trip or the enjoyment of other travelers.

You understand that certain activities may include loud music and sound-healing instruments. These experiences are intended to support holistic physical and spiritual well-being and are not substitutes for professional medical or psychological treatment.

You acknowledge that:

  • Linh James is not a licensed healthcare provider or therapist.

  • Participation in the Activities is not a replacement for medical care, psychiatric treatment, psychotherapy, or counseling.

  • The Activities may involve intense physical exertion, and by participating, you represent and warrant that you are physically fit and have no medical condition that would prevent your full participation.

You also understand that the Activities could:

  • Cause or aggravate a physical injury or medical condition.

  • Result in elevated heart rate, high blood pressure, fainting, heartbeat irregularities, physical injury, heart attack, stroke, or musculoskeletal injuries such as muscle, back, neck, or joint pain.

  • It is your responsibility to consult with a physician prior to participation. If you have done so, you affirm that you have followed your physician’s advice. You understand that the Teacher/Organizer reserves the right to refuse your participation in any activity on the basis of medical, physical, or other concerns at their sole discretion.

  • You affirm that you are self-aware of your physical limitations and agree to listen to your body, modify or stop your participation when necessary, and immediately cease any activity that causes discomfort or pain.

Additionally, you confirm that:

  • You have not been recently treated for, nor are aware of, any medical condition—physical or mental—that would pose an unreasonable risk to yourself or others during the retreat.

  • You are in compliance with any vaccination or health entry requirements of the destination country(ies).

  • You are responsible for carrying and presenting documentation such as proof of vaccination, COVID-19 testing, medical insurance, or other government-mandated forms required by authorities.

  • It is the traveler’s sole responsibility to stay informed of and comply with all relevant health and travel regulations. These requirements are subject to change, and it is your responsibility to remain up to date both before and during your trip.

ASSUMPTION OF RISK: You acknowledge that by its very nature, travel—especially the kind offered through our retreats and experiences—is more adventurous, demanding, and inherently riskier than conventional vacations. Destinations may have lower standards of accommodation, transportation, healthcare, hygiene, safety, and overall service than what you're accustomed to in your country of residence. These conditions may require you to exercise greater flexibility, awareness, and patience.

We are committed to creating a safe and supportive environment for all participants. However, you are responsible for your behavior, choices, and safety throughout the trip. You understand and accept the potential risks and hazards associated with both travel and participation in yoga-related activities. Some retreat locations are remote and may involve long travel times away from major towns or cities, meaning access to medical care could be limited or of a different standard than you’re used to.

Additionally, you may be exposed to unfamiliar political, cultural, or geographic environments that can present unique challenges or heightened risks. While we carefully assess each destination using available resources from the U.S. government, foreign authorities and trusted local contacts, it is ultimately your responsibility to stay informed about your chosen destination.

By confirming your reservation, you acknowledge that you have considered the available information and willingly accept the personal risks associated with your travel and participation.

Simply Put: You acknowledge that there are numerous risks you may face during your involvement in the Activities, including the risks listed here.

  • personal injury and/or death

  • travel to remote areas without access to medical facilities or treatment

  • changing weather conditions

  • interactions or encounters with wildlife

  • equipment malfunctions

  • negligence of other participants or guides

  • negligence on the part of the organizer, including failure to safeguard or protect from the risks or dangers of the Activities

  • consumption of alcohol

  • collisions with vehicles, equipment, or structures

  • becoming lost or separated from guides or other participants, and the failure to remain within designated areas.

ACKNOWLEDGMENT AND RELEASE OF LIABILITY: By confirming your reservation with payment, you acknowledge that you have read, understood, and agreed to the terms outlined in this Agreement. You understand that these terms include a release of liability for any injuries or damages you may incur and that if any part of this Agreement is found to be invalid, the remaining provisions will continue in full legal force and effect.

You also agree that neither you nor your heirs, assigns, or legal representatives will initiate any claims or legal actions of any kind against Linh James.

WAIVER AND RELEASE: In consideration of being permitted to participate in the Activities, you voluntarily assume full responsibility for any and all risks, injuries, or damages—known or unknown—that may result from your participation, including those arising from the negligence of the Teacher, Organizer, or any of their independent contractors, assistants, or representatives (each referred to as a “Released Party”).

You knowingly and expressly waive any and all claims (as defined below) against any Released Party. You also agree to indemnify and hold harmless each Released Party from any loss, cost, or liability—including legal fees—incurred in defending any claim made by you or on your behalf, even if that claim is alleged to result from negligence.

For the purposes of this Agreement, a “claim” includes, but is not limited to: any and all liabilities, demands, expenses, legal actions, or rights of action for damages, personal injury, emotional or psychological distress, or death that you, your spouse, children, or unborn child may suffer in connection with your participation in the Activities.

LIMITATION OF LIABILITY:  To the fullest extent permitted by law, you agree to release, waive, discharge, and hold harmless the Organizer from any and all claims, damages, losses, or liabilities—whether direct, indirect, incidental, consequential, or punitive—that may arise from or occur during your travel, accommodations, or participation in the retreat or any related activities. This includes, but is not limited to, claims relating to personal injury, illness, property damage, wrongful death, delay, loss of services, emotional upset, or other inconveniences unless caused by the gross negligence or willful misconduct of the Organizer.

By confirming your reservation, you acknowledge and accept the inherent risks involved in travel, yoga, and wellness-based retreat experiences. You are strongly encouraged to purchase comprehensive travel insurance to protect against trip cancellation or interruption, weather delays, medical emergencies, baggage loss, and other unforeseen events. Whether or not you choose to purchase travel insurance, you agree not to seek reimbursement from the Organizer or its representatives for any loss incurred during your travel or stay.

THIRD-PARTY OPERATORS:
Your trip does include services provided by third-party operators, which may include private boats, lodging facilities, airlines, ground or water transportation providers, tour guides, food service vendors, and others. These third-party operators are independent contractors and are not employees, agents, or affiliates of the Organizer.

While we carefully select reliable and reputable providers to support your experience, you acknowledge and agree that—except in cases of gross negligence by the Organizer—the Organizer is not responsible or liable for any acts, omissions, or failures of these third-party operators.

This includes, without limitation, any direct, indirect, incidental, or consequential damages, injuries, losses, costs, or expenses you may incur—whether related to personal injury, illness, death, property damage or loss, delays, or other inconveniences—arising from or connected to the actions or inactions of any third-party provider.

You also understand that all third-party operators comply with the laws and regulations of the countries in which they operate. The Organizer does not guarantee that these providers meet your home country's legal or regulatory standards or any other jurisdiction.

OPTIONAL EXTRAS:

"Optional Extras" refers to any activity, transportation, meal, product, or service that is not specifically included in the Tour itinerary or the Tour price and therefore does not form part of the Tour. If you choose to participate in any Optional Extras, you do so at your own discretion. Any assistance offered by the Tour Operator’s representative(s) in arranging, selecting, or booking Optional Extras is provided solely at your request. The Tour Operator makes no warranties and expressly disclaims any liability arising from your participation in these Optional Extras or from any information provided by its representatives. By choosing to engage in any Optional Extras, you agree to release the Tour Operator from all claims or causes of action related to any injury, loss, damage, inconvenience, or diminished enjoyment that may result.

PHOTOGRAPH & VIDEO RELEASE:

By participating in any retreat, tour, event, or class, you acknowledge that other participants may take photographs or videos, the organizer, the Tour Operator, or its representatives and that you may appear in some of this content. You give your consent to be photographed or recorded and grant a perpetual, royalty-free, worldwide, and irrevocable license to the organizer, the Tour Operator, its contractors, subcontractors, and assigns to use, reproduce, and distribute your image or likeness for any purpose—including educational use, marketing, promotions, and the creation of promotional materials—across any media now known or developed in the future, without any further obligation or compensation to you.

ALCOHOL AND ILLEGAL SUBSTANCES: If you use, consume, or are under the influence of alcohol or illegal drugs before or during the Activities, you assume and accept all risks, dangers, and hazards that may result from this—including, but not limited to, the possibility of personal injury, death, property damage, or loss—even in the event of negligence or fault by Linh James or any third party. You also agree to indemnify and hold harmless the organizer from any and all liability for damage to property or personal injury to any third party resulting from your participation in the Activities while under the influence of alcohol or illegal substances.

Simply Put:
If you consume alcohol or illegal drugs before or during your involvement in the Activities, you are responsible for any loss, injury, or damage you cause to yourself or others.

ARBITRATION: You agree that any dispute arising out of or relating to your booking, these Traveler Terms & Conditions, this Agreement, or any aspect of your trip (including any claim you may wish to assert) shall be resolved through confidential and binding arbitration in Orange County, California. The arbitration will be conducted by arbitrator(s) pursuant to mutually agreed-upon rules.

If the parties are unable to agree on the arbitrator(s) or the applicable rules, either party may petition a court of competent jurisdiction in Orange County, California, to compel arbitration. Any arbitration award shall be issued in writing and may be entered and enforced as a judgment in any court of competent jurisdiction.

By agreeing to this clause, all parties expressly waive their right to a trial, including trial by jury. Each party will bear its own attorneys’ fees and costs associated with the arbitration.

If you do not agree with any part of this Agreement or are unwilling to be bound by its terms, please do not proceed with the retreat registration.

By submitting payment, you confirm that you have read, understood, and agreed to all of the terms outlined in this Agreement.
