Welcome to our website; this website is owned and operated by Linh James (aka Guru Mitar). These Terms set forth the terms and conditions under which you may use our website and services as offered by us. The information contained on this website comes from ancient yogic traditions, spiritual teaching, and wellness practices. Nothing on this website should be construed as medical advice. The Content has been made available for informational and educational purposes only. 

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right, and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any applicable law or regulation.

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE, SUBSCRIBING TO THE SITE, OR PARTICIPATING IN ANY CLASSES OR RETREATS.

The Services are offered to you on the condition that you accept and agree to be bound by this Agreement in its entirety without modification of any kind.

By using this website, you signify your consent to these terms of use.  
We may amend these Terms from time to time, and such modifications shall be effective upon posting at any of our Websites. By accessing and/or using any of our Websites after any such modification is posted, you agree to be bound by such modifications. You also acknowledge and agree that it is your responsibility to monitor the Websites for the posting of modifications and to review such modifications on a regular basis.  Additionally, every time you wish to order any Services, please check these Terms to ensure you understand the terms which will apply at that time.

Your access to and use of this website is subject to the following terms and conditions (“Terms of Use”) and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, the Terms of Use and acknowledge that any other agreements between you and the Site are superseded and of no force or effect:

1. You understand that the breathwork and yoga classes, teacher training, workshops, retreats, healing sessions, spiritual counseling, life coaching, mentoring, and all other services provided by Linh James (aka Guru Mitar) are for the purpose of wholistic physical and spiritual wellbeing. You understand clearly that the above is not a substitute for medical or psychiatric treatment, psychotherapy, or any other forms of professional counseling or therapy. You understand that Linh James (aka Guru Mitar) does not claim to be a licensed medical provider or therapist and does not prescribe or perform medical treatments, prescribe medications and other drugs, or interfere with the treatment of a licensed medical professional. You should see a licensed physician or healthcare professional for any physical or psychological ailment you may have. You understand that individual healing manifests differently, and a particular outcome is not guaranteed.

2. You recognize that you must be in adequate physical and mental health to participate in any of the activities you decide to do. You understand that the activities may require intense physical exertion, and you represent and warrant that you are physically fit enough to participate and that you have no medical condition that would prevent your full participation in any of the activities. You recognize that the activities may cause or aggravate a physical injury or medical condition. You further understand that Breathwork can result in intense physical and emotional release. Breathwork is not advised for persons with severe mental illness or seizure disorders or for persons using major medications. It is also unsuitable for anyone with a personal or family history of aneurysms. Pregnant women are advised against practicing Breathwork without first consulting and getting approval from their primary care physician. You understand that it is your responsibility to consult with a physician before participating in any Activities available on this site.
By voluntarily participating in any activities within this site, you assume all risk of injury. You also understand that Linh James (aka Guru Mitar) encourages you to exercise and eat a healthy, well-balanced diet on your own to supplement the Yoga with Linh James (aka Guru Mitar) programs and that you, not Linh James (aka Linh James), assume all risks and responsibilities for your own actions, safety, health, performance, well-being, and any complications or injuries which may arise when exercising or eating on your own. 

3. When buying an item, you agree that: you are responsible for reading the full item listing before making a commitment to buy it: you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / and for our products are listed on the website. We reserve the right to change our prices for products displayed at any time and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.
We may, without prior notice, change the Services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
“The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged either as one-time charge or on a monthly basis to your payment method.

4. You agree that the Site itself, as well as all content, videos, training materials, products, services and/or other materials, made available on the Site by us or other third parties, as well as the look and feel of all of the foregoing, (collectively referred to as the “Content”), are maintained for your personal use and are the property of the Guru Mitar (aka Linh James) You agree that such Content shall include all proprietary videos, HTML/CSS, Javascript, graphics, voice, and sound recordings, artwork, photos, documents, and text as well as all other materials included in the Site, excluding only the materials you provide. Subject to your compliance with these Terms of Use, Guru Mitar (aka Linh James) hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site solely for your personal purposes. No Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by Guru Mitar (aka Linh James). You may not distribute, modify, transmit or use the content of the Site or any Content, including any and all software, tools, graphics, and/or sound files, for public or commercial purposes without the express written permission from Guru Mitar (aka Linh James)

5.  You understand that the Guru Mitar (aka Linh James) may photograph, video, or otherwise record classes or events you consent to interview(s), photography, videotaping and its/their release, publication, or reproduction to be used for public relations, education, advertising, inclusion on Web sites, or for any other purpose. You waive all rights you may have to any claims for payment or royalties in connection with any exhibition, televising, or other publication of these materials. and such photographs and videos on its Website. I hereby consent to the use of my image that may appear in any such photograph or video.  

6. While Guru Mitar uses reasonable efforts to include accurate and up-to-date information in the Site, she makes no warranties or representations as to its accuracy. Guru Mitar (aka Linh James) assumes no liability or responsibility for any errors or omissions in the content of the Site.

7. When you register on this Site, you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, or other records or correspondence from Guru Mitar (aka Linh James). You consent to receive notices electronically by way of transmitting the notice to you by email or text. By completing the registration procedures displayed on the registration page(s) of the Websites, you acknowledge and agree that (a) you are representing to us that you are providing true, accurate, current, and complete information about yourself as prompted by the registration form available on our Websites (the “Registration Data”), and (b) you are obliged to maintain and promptly update your Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, we reserve the right to suspend or terminate your account and refuse any and all current or future access to and/or use of the Websites and the Services (or any portion thereof).

8. Member Account, Password, and Security. As a Registered User, you are required to choose a password and provide your email address, and you may be asked for additional information regarding your account. You are responsible for maintaining the confidentiality and security of the password and all other account information, and you are fully responsible and liable for all access to and use of the Websites and the Services that occur under your password or account. You agree to immediately notify us by e-mail to info@gurumitar.com of any unauthorized use of your password or account or any other breach of security.  Guru Mitar (aka Linh James) will not be liable for any loss or damage arising from your failure to comply with this section.

9. Guru Mitar (aka Linh James) will not intentionally disclose any personally identifying information about you to third parties, except where the Company, in good faith, believes such disclosure is necessary to comply with the law or enforce these Terms of Use. 

10. You agree to indemnify and hold Guru Mitar (aka Linh James) harmless from any demands, loss, liability, claims, or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

11. To the maximum extent permitted by applicable law, in no event shall Guru Mitar (aka Linh James), be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Guru Mitar (aka Linh James) assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

12. You agree to indemnify and hold harmless each Released Party from any loss, cost, or liability incurred in defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the negligence of any Released Party or anyone else.  “Claim” includes but is not limited to any and all liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, mental suffering, and distress, or death that I may suffer, my spouse, children or unborn child may suffer (including any legal fees or expenses) in connection with participation in any program, service or activity with Guru Mitar (aka Linh James). 

You, your heirs, or legal representatives forever release, waive, discharge and covenant not to sue any Released Party for any Claim caused by any negligence or other acts of a Released Party. 

This agreement shall be construed in accordance with, and governed by, the laws of the State of California and that all actions, suits, claims, and proceedings relating to this agreement shall be brought in a court of competent jurisdiction located in Los Angeles, California. In case any provision of this agreement shall be held invalid, illegal, or unenforceable, it shall not affect any other provision of this agreement and this agreement shall be construed as if such provision had never been contained herein.

You acknowledge that you have carefully read this agreement and fully understand its contents. You voluntarily and knowingly agree to the terms and conditions stated herein. 

You are aware that by accepting this agreement, you are giving up substantial rights, including your right to sue and certain legal rights my heirs, next of kin, executors, administrators and assigns may have against any Released Party.
